1. Якщо процедура верифікації, зазначена в статті 19 цього Протоколу, або якщо інформація, що є в компетентних органів Співтовариства або в компетентних органів України, показує або з неї зрозуміло, що мають місце порушення або недотримання умов цієї Угоди, обидві Сторони разом, з відповідною наполегливістю, співробітничають з метою запобігання будь-якому такому порушенню або недотриманню умов.
2. Із цією метою відповідні органи України за власною ініціативою або на прохання Співтовариства проводять відповідні розслідування або організовують проведення таких розслідувань стосовно операцій, які є або вважаються Співтовариством порушенням або недотриманням цього Протоколу. Компетентні органи України повідомляють результати цих розслідувань Співтовариству, зокрема будь-яку іншу відповідну інформацію, що дозволяє розкрити причини порушення або недотримань умов, зокрема встановлення справжнього походження товарів.
3. За домовленістю між Сторонами посадові особи, призначені Співтовариством, можуть бути присутні при розслідуваннях, зазначених вище в пункті 2.
4. На виконання умов співробітництва, зазначеного в пункті 1, компетентні органи Співтовариства та України обмінюються будь-якою інформацією, яку кожна зі Сторін уважає корисною для запобігання порушенню або недотриманню положень Угоди. Ці обміни можуть стосуватися інформації про торгівлю виробами, що охоплюються цією Угодою, між Україною й третіми країнами, зокрема, у випадках, коли Співтовариство має вагомі підстави вважати, що до ввезення до Співтовариства відповідні товари транзитом проходили через територію України. На запит Співтовариства, ця інформація може включати копії всієї наявної відповідної документації.
5. За наявності достатніх доказів порушення або недотримання положень цього Протоколу, компетентні органи України та Співтовариства можуть погодитись стосовно вжиття будь-яких заходів, необхідних для запобігання повторним порушенням.
